OFFICE MEMORANDUM.
SUBJECT: Sponsoring of public funds by Governmentservants,

The Government Servants Conduct Rules applicable to the late Secretary of State's Servicos, require that no Government servant should, without obtaining the previous permission of the Government, ask for, or accept or in any way participate in the raising of, any subscription or other pecuniary assistance in pursuance of any object whatever, A copy of the relevant Rule is given below for ready reference:-

2."Except with the previous sanction of the Government, if he is a Commissioner of a Division or a Head of a Department, or of the Commissionur or the Head of his Department in other cases, no Government servant shall ask for, or accept, or in any way participate in the raising of, any subscription or other pecuniary assistance in pursuance of any object whatsoever."

The position under the Conduct Rules applicable to other Government servants is slightly different but it has been decided that the same rule should apply to all Central Government servants, so far as public funds are concerned.

3.This position may pleasc he explained to all the employees of the Kinistry of Finance and their attached and subordinate etc offices and it may be impressed upon them that they should not sponsor th raising of funds from the public for any purpose whatsoever, without previous permission. It may be added that the mere payment of a subscription to some charitable or benevolent fund would not, by itself, amount to participation in the rafsing of such fund; and is permissible except in circumstances speciffed

I am directed to forward herewith a copy of order dated 05.09,2018 of the Hon’ble High Court, Jodhpur Bench in DBCWP No. 2810/2014 filed by Shri Ram Swaroop Joshi Vis UOI, & others on the above mentioned subject wherein it has been ordered that:-

“The Tribunal has correctly noted that the anomaly is not on account of promotion but on account of the fixation of pay in the new pay scale.”

You are requested to kindly circulate these orders to all your subordinate offices for information/defending such cases in CAT.

OFFICE MEMORANDUM

Subject : Reimbursement of rent to Government servants during their temporary stay (upto a maximum period of six months) in State Bhavans/Guest Houses/ Departmental Guest Houses run by Central Govemment/State Governments /Autonomous Organizations etc.

Several references are being received in this Department seeking clarification regarding applicability of instructions contained in this Department’s O.M, No. 2(25)/2004-E.11(B) dated 15.12.2011 to entral Government officials on their stay in Stale Bhavans,'Guest Houses and also in cases where Central Government offciais stay in Departmental Guest Houses.

2. The matter has been considered in this Department, In supersession of the instructions contained in
aforesaid O.M. dated 15,12.2011, it has been decided that the officials on their posting to the Centre and the Central Government officials on their transfer/posting to a new station, necessitating change of residence if they temporarily stay in State Bhavans/ Guest Houses/Departmental Guest Houses run by Central Government / State Government / Autonomous Organizations etc,, may be reimbursed the amount of rent paid subject to fulfillment of the following conditions:

(a) The official has applied for accommodation of his entitlement, but has not been allotted residential accommodation by the Government,

(b) The concerned Guest House should be located at the place of posting of the official.

(c) The official must have stayed in State Bhavans/Guest Hou^Departmental Guest Houses run by Central Govemment/State Govemment/Autonorr.ous Organizations etc and submit rent receipts in support of payment of rent.

(d) Reimbursement of rent shall be admissible up to a maximum period of six months.

(e) No House Rent Alloiwance (HRA) shall be admissible during this period.

These orders shall be effective from the date of issue.

In so far as the persons serving in dve India Audit and Accounts Department are concerned, mese orders issue in consultation with the Comptroller & Auditor General of India.
